Right to a Divorce
What is required in Washington State to get divorced? The only requirement in Washington State to get divorced is that you be in a legal marriage. A legal marriage is generally one that included a marriage certificate and ceremony before a person authorized to solemnize marriages. Divorce is a matter of right and anyone in a legal marriage can seek one for any reason. Washington is a “no fault” state, meaning that there is no requirement to assign blame or fault before being able to proceed with a divorce. The court only requires that one party assert that the marriage is “irretrievably broken” in order for the case to start and finish with the entry of a divorce decree.
