Practice Emphasis

Mario joined LHS&E as an associate attorney in 2001 and became a principal in the firm on January 1, 2008.  His legal practice is focused exclusively in litigation, with primary areas of emphasis in real estate and commercial litigation. 

Mario comes from a real estate minded family and has an intimate understanding of the nuances of real property law. He advises both individual and corporate clients in all types of real estate litigation including:

• Real Estate Contract Disputes (including purchase and sale disputes);
• Title and Warranty Disputes;
• Possession Disputes (including adverse possession);
• Easement Disputes;
• Timber and Tree Cutting Disputes; and
• Trespass and Nuisance Disputes.


Mario is also well recognized as a complex commercial litigator, having been named a “Rising Star” by Washington Law and Politics Magazine (2007, 2008, 2009, and 2010) in the area of Business Litigation.  He represents corporate clients in a wide range of commercial litigation matters including:

• Insurance Claims; and
• Collection Disputes.

Real Estate Litigation:

  • Timber Trespass Disputes – On behalf of homeowner clients, Mario has aggressively and successfully sued and recovered from neighboring homeowners for trespass and unlawful tree cutting.
  • Purchase and Sale Disputes – Working for both buyers and sellers, Mario has guided numerous clients through lawsuits over breach of the Northwest Multiple Listing Service Real Estate Purchase and Sale Agreement, and related addenda.
  • Adverse Possession Claims – Mario has successfully quieted title to real property using the law of adverse possession.
  • Quiet Title – Through quiet title lawsuits, Mario has successfully removed numerous “clouds” interfering with his client’s title ownership to their property.
  • Easement –On behalf of homeowner clients, Mario has litigated the interpretation, rights, and responsibilities of easements held against title.
  • Lease Disputes—Mario has negotiated and resolved numerous lawsuits related to the breach of commercial leases.
  • Real Estate Fraud – Mario has both buyers and sellers in lawsuits alleging material misrepresentations made in connection with real estate purchase and sale agreements.

Commercial Litigation:

  • Shareholder Litigation– On behalf of minority shareholder clients, Mario successfully sued the majority shareholders for breach of fiduciary duties, conversion and fraud.
  • Employment Litigation— Mario works with both employers and employees in the prosecution and defense of employment related claims, including wage and hour disputes, non-competition agreements, and unlawful discrimination lawsuits Working with fellow employment attorneys at Lasher Holzapfel Sperry & Ebberson, Mario recently obtained a jury verdict at trial against a government entity for sex and race discrimination and defamation.
  • Conversion and Fraud—Admitted Pro Hac Vice in Nevada Federal District Court, Mario successfully sued out-of-state defendants for conversion and fraud against his client.
  • Sales Contract Disputes — Working with litigation attorneys at Lasher Holzapfel Sperry & Ebberson, Mario assisted in the defense of a $2.2 million claim made against his corporate client related to the supply of product to a military contractor.
  • Collection Litigation — Mario recovered more than $254,000 owing to his corporate client on an unpaid open account by successfully suing the corporate debtor’s individual owners.
