Representative Cases

• In re Ronald Grayson, LTS Corporation, RVL Limited Partnership, MVG Trust & Middle Trust
  After five days of trial testimony, Tony obtained a $2.6 million nondischargeable judgment on behalf of a trust beneficiary against her trustee for breach of fiduciary duties, fraud and defalcation. The court also found joint and several alter-ego liability for all damages by two other trusts, a business corporation and a limited partnership. 
• Inficom, Inc. Litigation 
• After trial, Tony obtained an $840,611 judgment against a commercial tenant and guarantors, including all attorneys’ fees and costs.
• In re Calozza Litigation
  Tony served as co-counsel for local investors defrauded by their broker. He helped prosecute and then settle a federal court securities class action lawsuit with a $3.65 million present value.
• Peterson v. Norwest Mortgage Corporation
  As lead counsel acting as private attorney’s general, Tony obtained a permanent injunction and $5.5 million class action settlement fund from a national mortgage lender based upon its assessment of illegal document preparation fees from its borrowers.
• Ebling v. Goves Cove Inc.
  Representing a commissioned yacht salesman, Tony obtained a judgment after trial for twice the unpaid commissions plus substantial attorneys’ fees and interest, then protected the judgment through appeal. Ebling v. Goves Cove Inc., 34 Wn. App. 495 (1983), is the seminal authority on willful, wrongful withholding of wages.

In other cases, Tony:

• Defeated then compromised claims brought in federal court of trademark, tradename and tradedress infringement brought by a multinational oil company that had terminated license rights held by a local lubricant manufacturer. The compromise agreement allowed the companies to continue to do business together in marketing that product line.
• Successfully prosecuted negligence and products liability claims on healthcare to settlements totaling $1,050,000.
• On behalf of the buyer of a building, enforced a use restriction against the seller/tenant through a commercial eviction trial, which terminated the tenancy to his client's financial benefit.
• Defended the guarantor of a local television station’s debts against the syndicator in a multi-million dollar action for breach of contract and copyright violations, and ultimately effected a settlement for a fraction of the debt payable over time.
• Represented five overlapping oil and gas general partnerships with multi-million dollar investments, terminated the managing partner, and defended the action through trial and on appeal, and then back to further Superior Court trial proceedings. The process resulted in a substantial damages recovery.
