Trademark Registrations

Protect your brand. Protect your investment.

Your business has set itself apart from its competitors through quality goods and services. Those years of quality are now symbolized by your trademarks (names, logos, and taglines). Today, when a customer sees your trademark, they know instantly where this product came from, and they are certain that they will once again get quality.

Sometimes your competitors will start using similar trademarks by coincidence. But sometimes, unscrupulous competitors will use your exact trademark, or a similar trademark, because they want a short-cut; they can sell their own products for much more just by placing your trademark on them. Such infringers not only steal the fruits of your hard labor, they destroy your business’ goodwill in the process.

The most effective way to deal with both competitors is to register your trademarks as soon as you know you will use them. Few infringers will put up a fight when shown a registration certificate; proof that you already correctly registered that trademark. This is because trademark registration greatly increases the size of the hammer you wield against infringing competitors. In addition, the federal and various state trademark registration laws offer significant legal incentives for you to register your trademarks early. For all of these reasons, timely registration of your key trademarks is important; not only to make your business an attractive acquisition target, but also for its long-term survival.

The attorneys and staff of the Trademark Registration group at Lasher Holzapfel Sperry & Ebberson, PLLC have the experience to effectively and cost-effectively guide your business through the trademark selection, registration, and maintenance processes, whether at the international, U.S. federal, or U.S. state level. In addition, both attorneys have advanced tax degrees, and can help you and your CPA work through strategies related to capitalization of associated costs, amortization, and tax treatment on purchases and sales of trademarks.

Trusts & Estates Litigation

Trust and estate disputes are uniquely complex and demand professionals who are both skilled at understanding the complicated family dynamics that are often involved and experienced in the variety of legal tools that are available for resolving such disputes.

The depth and breadth of experience of the Trust & Estate Disputes and Litigation team at Lasher are exceptional. The group includes seasoned litigators, skilled mediators, and attorneys who are highly accomplished in utilizing Washington’s Trust and Estate Dispute Resolution Act (TEDRA), which is very often involved in dealing with trust and estate disputes. Every case is unique and therefore each case is evaluated to determine what legal tool – or combination of tools – is most appropriate for the case at hand. We are prepared and able to use a variety of creative and effective approaches to resolve trust and estate disputes, and are able and prepared to employ everything from informal negotiation and problem-solving techniques to full-scale discovery and litigation.

Trust and estate disputes typically involve a variety of different parties, including trustees, executors and other fiduciaries (both professional and nonprofessional); the estate or trust itself; adult and minor beneficiaries; court-appointed guardians and special representatives; and financial companies. Members of Lasher’s Trust & Estate Disputes and Litigation group have successfully represented many different parties involved in a variety of types of trust and estate disputes. Here are just a few examples of the cases that members of our team have successfully handled in the recent past:

  • Served as court-appointed guardian ad litem for three minor beneficiaries involved in a dispute about the distribution of a trust their grandmother had established before her death; matter successfully resolved in mediation.
  • Represented a beneficiary of a trust who sought to have a trustee appointed when all of the named trustees were either unwilling or unable to serve; client’s selected trustee was appointed by the court.
  • Represented a surviving spouse whose husband died in a tragic accident after which other family members claimed an interest to a trust the husband’s mother had established for him; case successfully concluded in mediation.

Whether your situation involves a will contest, an alleged breach of fiduciary duty, a desired or necessary change to an irrevocable trust, or some other trust or estate issue, our Trust & Estate Disputes and Litigation team would be glad to talk with you and assess the situation. We welcome your inquiries.

Estate Planning, Trusts & Probate

Creating an estate plan or serving as a trustee or as a personal representative in a probate can be overwhelming. The estate planning, trusts and probate practice group at Lasher Holzapfel Sperry & Ebberson offers broad experience and personalized services to help you navigate the complexities of both local and federal law and make sound decisions. We have an exceptional team of attorneys and paralegals that are responsive, experienced, and efficient. We regularly collaborate to produce the best solutions for our clients, drawing on our collective knowledge and experience to address complex or challenging matters. Where appropriate, we also work with lawyers from our firm’s other practice areas such as Real Estate, engage in joint efforts with our Corporate & Business Law group in business succession matters, and collaborate in contested trust and probate matters with members of our Trust & Estate Disputes Group.

Advanced Estate and Tax Planning

Washington is currently the only state in the nation to have an estate tax and no income tax. Further, Washington has a state tax exemption that is a different amount from the federal tax exemption and currently has no gift tax. Our estate planning attorneys understand this complex tax framework and routinely design sophisticated estate plans to help our clients reduce federal estate and gift taxes as well as Washington estate taxes. Our estate planning attorneys will review your goals and assess whether to utilize advanced estate planning tools such as Grantor Retained Annuity Trusts, Irrevocable Life Insurance Trusts, Charitable Lead Trusts, Charitable Remainder Trusts, Generation Skipping Trusts, Qualified Personal Residence Trusts, Family Limited Liability Companies, and income tax free sales to trusts.

Succession Planning for Companies

Once a business becomes successful and the founders reach retirement, the company must then traverse a difficult path to successfully pass on the control and ownership of the business. From outlines and checklists to complete succession plans, we help our clients transition their prosperous businesses to their families, and sometimes to their employees. This is a critical stage in the life cycle of any private business, and one that must be given high priority and which requires careful business and tax planning. We have assisted hundreds of clients with such plans, ensuring that valuable companies can carry on and prosper for generations.

Probate, Post-mortem Tax Planning and Trust Administration

When a death occurs in a family, we provide compassionate and efficient service at a difficult time. Our probate department helps executors manage and protect the assets of an estate, determine the validity of and pay creditor’s claims, resolve disputes among beneficiaries, and conduct valuable after-death tax planning. We also represent trustees of revocable living trusts and irrevocable trusts, providing counsel and direction regarding trustee duties, trust taxation, and trust distribution matters.
